The actions of Shawano County DHS raises significant concerns under the Supremacy Clause of the United States Constitution. Federal statutes enacted by Congress, including the Indian Child Welfare Act, preempt conflicting state action. A state agency may not redefine, narrow, or disregard federal statutes governing tribal jurisdiction. By continuing to exercise authority after jurisdiction had been transferred, Shawano County acted outside the lawful limits of state authority. Additionally, the conduct of county officials demonstrates a pattern of procedural irregularities and misuse of the state child welfare system in a matter that had already been placed under tribal court supervision. These actions resulted in the removal of my minor children and caused significant disruption to the family structure and to the jurisdiction of the tribal court. The conduct described herein raises serious concerns regarding violations of federal law, abuse of administrative authority, and interference with tribal sovereignty. The actions of the county appear inconsistent with the statutory protections enacted by Congress and the obligations imposed upon state agencies when handling matters involving Indian children. I provide this statement as part of a broader effort to document violations of federal law, interference with tribal jurisdiction, and misuse of governmental authority in matters involving my family and my children.
